With few exceptions, most employees are entitled to a wage of at least $7.25 per hour for each hour worked. Most employees are also entitled to be paid time and a half for overtime hours work.

The overtime rules do not apply to employees whose duties fit specific legal exemptions. However,, your employer may have misclassified you as exempt when you are not. The most important thing to remember is that it is the law and your actual duties that control whether you get overtime – not your agreement with your employer, or the title of your job position.

Even when your employer pays you at the correct rate, your employer may have failed to count all of the time for which you are entitled to compensation. Failure to count all hours worked can result in minimum wage violations, if your total pay divided by your real hours does not result in the required hourly minimum. Failure to count all hours can also result in overtime violations, if some of your overtime hours are not compensated.
